Terms of Service

1. Service Description

streqo is a gym attendance tracking application designed for Brazilian Jiu-Jitsu (BJJ) academies and martial arts gyms. The Service enables:

• NFC and QR check-ins: Members record their attendance by tapping their phone on an NFC tag or scanning a QR code at their gym.
• Streak and progress tracking: Automatic tracking of training streaks, class counts, and belt progression milestones.
• Gym administration: Tools for gym owners and coaches to manage members, view attendance analytics, and configure belt systems.
• Notifications: Optional push notifications for streak reminders, class alerts, and milestone celebrations.

2. Account Requirements

• You must be at least 16 years old to create an account and use the Service.
• You may only create one account per person. Multiple accounts for the same individual are not permitted.
• You must provide accurate and complete information when creating your account and keep it up to date.
• You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.
• You must notify us immediately if you become aware of any unauthorized use of your account.

3. Acceptable Use

When using the Service, you agree not to:

• Falsify check-ins: Record attendance when you are not physically present at the gym, or manipulate check-in data in any way.
• Use automated tools: Employ bots, scripts, or any automated means to interact with the Service, including automated check-ins.
• Impersonate others: Use another person's account or check in on behalf of someone else without proper authorization.
• Interfere with the Service: Attempt to disrupt, overload, or compromise the security or integrity of the Service or its infrastructure.
• Reverse engineer: Decompile, disassemble, or reverse engineer any part of the Service, except as permitted by applicable law.
• Abuse NFC infrastructure: Tamper with, clone, or otherwise misuse NFC tags or QR codes deployed by gyms.

4. Intellectual Property

Your Data: You retain ownership of the personal data you provide to the Service (your name, avatar, etc.). By using the Service, you grant us a limited license to use this data solely for the purpose of providing and improving the Service, as described in our Privacy Policy.

5. Gym Administrators

If you are a gym owner or coach using the administrative features of the Service:

• You are responsible for ensuring that your use of the Service complies with applicable data protection laws, including informing your members about the collection of their attendance data.
• You agree not to misuse member data accessed through the administrative features for purposes unrelated to gym management.
• You acknowledge that administrative permissions are role-based and must be used in accordance with your designated role.

6. Account Termination

• By you: You may delete your account at any time using the in-app "Delete Account" feature. Upon deletion, your profile data will be anonymized as described in our Privacy Policy.
• By us: We reserve the right to suspend or terminate your account if you violate these Terms, including but not limited to falsifying check-ins, using automated tools, or engaging in conduct that harms other users or the Service.
• We will make reasonable efforts to notify you before or promptly after any suspension or termination, unless doing so would compromise the security of the Service.

7. Service Availability

We strive to keep the Service available and reliable, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.
• Our total liability for any claims arising from these Terms or the Service shall not exceed the amount you have paid us in the twelve months preceding the claim, or 50 EUR, whichever is greater.
• We are not responsible for the accuracy of attendance data resulting from hardware malfunctions, network issues, or improper use of NFC tags or QR codes.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms or your misuse of the Service.

10. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Romania.

Nothing in these Terms affects your statutory rights as a consumer under European Union or Romanian law.

11. Changes to These Terms

We may update these Terms from time to time. When we make significant changes, we will notify you through the app or by other appropriate means. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
